N.carolina Child visitation rights of child?

A custody visitation court hearing is in order. You don't need a lawyer or money for that. They will have some one look into the accusations and find out what the deal was. Your child will, at her age, get her chance to express her feelings on the situation. She is old enough to make a lot of her own choices and the courts will take all this into consideration. You are wise not to just take your daughter. If you want a snow chance in hell at winning in the court system, then you need to 'play' fair. If there was NO court order in that state, then it needs to be done. It is a great possibilty that a hearing will have to be made in the old court for a change of venue or whatever it is called there. Then another in the new state. Once a judge decides and you get actual visitation with your daughter and the mother still interferes, you can file a show cause court doent on her and the judge will decide what happens from there. Good luck. I would get started right away. If you go to the local juvenile and domestic relations court office they will tell you if a hearing has to be in the 'old' state first. This process usually takes sometime, so like I said get started right away. If the mother fights it, it all could take up til the time she is 18 and then she will be free to choose. I doubt it will happen like that though. Good Luck.
